Recently there was a change to the procedure for pursuing medical malpractice-related claims in Kentucky. This recent change became a new law and is found in KRS Chapter 216C. Despite bold claims by lawmakers, the new legislation is not expected to significantly decrease litigation costs. However, it is expected to eliminate cases with questionable liability and the frequency of pre-trial settlements. The new law requires a victim of alleged medical negligence to submit his/her claim to a panel composed of three medical professionals. That panel then renders a decision. Despite the holding of the panel, a litigant may continue with his/her action to the appropriate court where the jury will get to hear the opinions of the panel as well as other evidence.
